COMPETITION RULES - INSTAGRAM 2021

ARTICLE I: ORGANISER

TERRE DES 2 SOURCES - SCEA with a capital of 100,000.00€, La Plaine - 34190 Montoulieu cedex, RCS Montpellier D 843 352 519, (“the Organiser”), is organising this competition

(“the Competition”).

 

These Competitions are neither organised nor sponsored by Instagram. Instagram shall not be held responsible, where applicable, for any breaches of the law in the way it is run and/or conducted. Instagram is not associated with these events.

ARTICLE II: ACCEPTANCE

By participating in the Competition, each participant:

- Is deemed to have read these rules and fully and irrevocably accepts their provisions.

- Is informed that any failure to comply with the rules will result in his/her permanent exclusion from the Competition and possibility of obtaining any prize, without prejudice to any damages that the Organiser may demand.

ARTICLE III: PARTICIPATION

These Competitions are free and open to any natural person of legal age residing in metropolitan France, with access to the Internet, a valid email address, and an Instagram account.

Corporate representatives, staff and members of their families of the Organiser and of any company that has directly or indirectly participated in the design, production or promotion of these Competitions are not eligible to participate.

The company reserves the right to carry out all necessary checks on the identity, postal address and/or e-mail address of participants.

The Competitions are subject to the regulations of French law applicable to competitions.

Only one entry per person is accepted, and the Organiser may carry out any checks in this respect without having to inform the participants of the exercise of checks concerning them and their subsequent exclusion.

ARTICLE IV: TERMS AND CONDITIONS

To participate in Terre des 2 Sources Instagram Competitions, participants must:

- Have a valid Instagram account

- Go to the Terre des 2 Sources Instagram page, accessible at https://www.instagram.com/terre2sources/, and then to the post dedicated to the Competition.

- "Like" the Competition publication on the feed of the Terre des 2 Sources Instagram page.

- Follow the entry instructions within the dedicated post.

Registration for the prize draw is only effective once these steps have been completed. The participation dates for each Competition are indicated on the publication dedicated to the Competition.

ARTICLE V: PRIZES

The number of winners, for each Competition will be indicated in the subsequent post dedicated to the relevant Competition. Winners will obtain the prize indicated in the post dedicated to the relevant Competition. The prize may in no case be exchanged for its cash value or for any other prize. The Organiser shall not be held responsible for the use or non-use, trading or loss of the prize by the winner. The Organiser reserves the right to verify the age of any winner before awarding the prize and to replace the prize won with a prize of equivalent or greater nature and value.

ARTICLE VI: INFORMATION

A random draw will be held to select the winner(s) from qualifying participants of the relevant Competition posted on the Terre des 2 Sources Instagram page. The draw will take place on the date mentioned in the publication dedicated to the Competition.

The winner(s) will be informed within 7 days of the draw and no telephone calls, letters or emails will be sent to participants who have not won.

The winner(s) will be contacted, via a private Instagram message, following the draw by the Organiser to obtain their full contact details (surname, first name, address, telephone, e-mail), which are essential for the award of the prize, and to confirm the nature of the prize and the procedures for delivery/collection.

Any winner who does not respond within 7 days of the notification of his/her prize by the Organiser shall be deemed to have renounced his/her prize, forfeiting their award, and the prize will become the property of the Organiser, who may choose to award it to another person via another random draw. If the winner's contact details are invalid, incomplete or erroneous, he/she will lose the benefit of his/her prize.

The prize shall be sent to the winner by post, by recorded delivery or Colissimo, to the postal address indicated by the winner. The Organiser shall not be held responsible in the event of loss or theft of the letter or package by the postal services. Alternatively, the prize may be collected from the Organiser through prior arrangement.

ARTICLE VII: LIABILITY AND CLAIMS

No telephone request or claim concerning the application or interpretation of these rules will be answered. Any dispute or claim relating to the operation must be made by registered letter to the Organiser’s address, with acknowledgement of receipt, sent within a maximum of 7 days, as evidenced by the postmark, after the announcement of the winner(s). This letter must indicate the precise date of participation in the operation, the participant's full contact details and the exact reason for the dispute. No other method of dispute or claim can be taken into account.

The Organiser reserves the right to cancel, modify, suspend or extend the game for any reason and without being held responsible. In particular, it may replace the prizes with prizes of similar or greater nature and commercial value. Participation in the game implies knowledge and acceptance of the limits of the Internet, particularly with regard to technical performance, response times, risks of interruption, and more generally the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data, the risks of contamination by viruses etc. Consequently, the Organiser cannot under any circumstances be held responsible, without this list being restrictive: for any network malfunction, equipment or communications failure; for the loss of mail or data; for the functioning of any software; for the consequences of viruses, anomalies or technical failures of any kind that prevent or limit participation in the game. The Organiser cannot be held responsible for any delay, loss, theft, deterioration, non-receipt of the prizes or the lack of legibility of the stamps, due to the postal service or any similar third party service provider. The Organiser declines all responsibility for any damage that may occur during the use/enjoyment of the prizes and excludes all responsibility for any dissatisfaction of the winners regarding their prizes.

ARTICLE VIII: PERSONAL DATA

Terre des 2 Sources undertakes not to infringe on the privacy of the users of the site and the confidentiality of the information provided. The information requested from the user is necessary to process the order.

In accordance with the French Data Protection Act of 6 January 1978, as amended, you have the right to access and rectify any personal data concerning you. You can exercise this right by sending an e-mail to admin@terredes2sources.com or by writing to the customer service department at the following address :

Terre des 2 Sources, La Plaine, 34190 MONTOULIEU. You may also, for legitimate reasons, object to the processing of data concerning you.

ARTICLE IX: ACCEPTANCE OF THE RULES

Participation in the Competition implies full and complete acceptance of these Rules.

Any practical difficulties in interpreting or applying these Rules shall be decided by the Organiser.

ARTICLE X: APPLICABLE LAW AND JURISDICTION

The Rules are subject to French law. Any complaint must be sent no later than 30 days after the closing date of the Contest, to the following address :

If no agreement is reached, any dispute will be submitted to the competent court according to the legal rules.
